This targeted approach directly addresses the “bad actor” problem lawmakers cite—without criminalizing responsible companies or depriving consumers of safe, effective alternatives. Recent reporting underscores that the language would ban products with more than ~0.4 mg total THC per container—a limit so low that it would capture non-intoxicating, full-spectrum offerings alongside intoxicating items, while industry and even some Republican lawmakers have raised alarm over the scope and tactics of the provision.
